Purchase Terms and Conditions
1. General Provisions
1.1. These rules of the electronic shop (hereinafter referred to as the “Rules”) constitute a legally binding document for the Buyer and the Seller (hereinafter referred to as the “Seller”), setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to amend, modify, or supplement these Rules at any time. The Buyer shall be informed of any changes to the Rules on the electronic shop’s website.
2. Conclusion of the Purchase–Sale Agreement
2.1. A purchase–sale agreement between the Buyer and the Seller shall be deemed concluded when the Buyer creates and submits an order for goods in the electronic shop after familiarizing themselves with these Rules.
3. Seller’s Rights
3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the electronic shop without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the electronic shop or violates their obligations, the Seller has the right, without prior notice, to restrict or suspend the Buyer’s access to the electronic shop.
4. Seller’s Obligations
4.1. The Seller undertakes to provide access to the electronic shop services under the conditions set out in these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, in accordance with the conditions set out in these purchase–sale Rules.
4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the electronic shop, the Seller has the right to terminate the purchase–sale agreement after informing the Buyer in advance. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the paid amount within 14 calendar days.
4.4. If the Buyer exercises the right provided for in Clause 5.2 of the Rules, the Seller undertakes to refund the Buyer within 14 (fourteen) calendar days from the date of receipt of the returned goods.
4.5. The Seller may withhold the refund until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
4.6. All goods sold in the electronic shop are manufactured only after confirmation of the Buyer’s order.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the electronic shop in accordance with these Rules.
5.2. The Buyer has the right to withdraw from a purchase–sale agreement concluded in the electronic shop by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods, except in cases where goods are manufactured according to special instructions.
5.3. The right discussed in Clause 5.2 may be exercised only if the goods have not been damaged, have not substantially changed in appearance, and have not been used.
6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure set out in these Rules.
6.2. If, upon delivery, the Buyer refuses to accept the goods without valid reasons, the Buyer must cover the costs of returning the goods at the Seller’s request.
6.3. Upon delivery of the goods, the Buyer must check the condition of the shipment and the goods together with the Seller or the person delivering the shipment.
6.4. By using the electronic shop, the Buyer confirms that they agree with these purchase–sale Rules and must comply with them.
7. Prices of Goods
7.1. Prices of goods in the electronic shop are indicated in euros and include taxes. Upon confirmation of the order, a delivery fee is added to the total price of the goods, if applicable.
8. Ordering and Payment for Goods
8.1. After visiting the electronic shop, the Buyer selects the desired goods and adds them to the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary for order fulfillment: name, surname, delivery address, telephone number, and additional information that may be important for delivery. The Buyer confirms that they have read these Rules and confirms the order.
8.3. Payments can be made using Visa / MasterCard payment cards, Applepay. Payments are accepted in euros. Payments are processed using the Stripe payment platform.
9. Delivery of Goods
9.1. When ordering goods, the Buyer must specify an accurate delivery address.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods personally but they are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding delivery to an improper person.
9.3. The Seller delivers the goods to the Buyer in accordance with the delivery terms specified in the product descriptions.
9.4. The characteristics of all goods sold are indicated in the description provided with each product.
9.5. Product images presented in the electronic shop are for illustrative purposes only. Although the Seller makes every effort to display product colors as accurately as possible, the Seller cannot guarantee that the Buyer’s device screen will accurately reflect the colors of the goods. The Buyer understands that the goods may differ slightly from their images.
9.6. If the Buyer withdraws from the purchase–sale agreement, all amounts paid by the Buyer, including delivery costs, shall be refunded.
10. Return of Goods
10.1. Goods of proper quality may be returned within 14 days from the date of receipt. Defects of sold goods of improper quality shall be remedied, and such goods shall be replaced or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. The returned goods must be in original, undamaged packaging (this does not apply when returning defective goods);
10.2.2. The goods must not be damaged by the Buyer;
10.2.3. The goods must be unused and must not have lost their commercial appearance: labels intact, protective films not removed, etc. (this does not apply when returning defective goods);
10.2.4. The returned goods must be in the same set as received by the Buyer (this does not apply when returning defective goods);
10.2.5. The Seller has the right to refuse to accept returned goods if the return conditions have not been complied with;
10.2.6. Goods must be returned in the manner specified by the Seller within 14 (fourteen) days from the date of receipt of the goods (this does not apply when goods are defective, in which case returns are carried out within the statutory warranty period).
10.3. The return and exchange of goods of proper quality shall be carried out in accordance with Article 6.228¹⁰(1) of the Civil Code.
10.4. Money paid for goods accepted by the Buyer but later returned shall be refunded to the Buyer’s account no later than within 5 (five) days from the date the goods are returned to the Seller, unless otherwise agreed by the Buyer and the Seller.
10.5. The Buyer may not return goods manufactured according to special instructions in accordance with Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on consumer protection in respect of distance contracts.
11. Final Provisions
11.1. These Rules are drawn up in accordance with the laws of the Republic of Lithuania.
11.2. These Rules and the legal relations between the Parties arising from them shall be governed and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. Any disputes arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be released from the fulfillment of obligations under these Rules if such fulfillment is impossible due to unforeseen circumstances beyond the control of the Parties (force majeure).
11.5. Requests or complaints regarding goods or services purchased in our electronic shop may be submitted to the State Consumer Rights Protection Authority (A.
